Terms of Service — The Ember Report

These Terms of Service ("Terms") are a binding agreement between you and Ash Media Group, Inc., a California corporation, doing business as The Ember Report ("Company," "we," "us," "our"), the operator of The Ember Report ("Ember," the "Service"), available at ember.report. By creating an account, subscribing, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. What the Service is
The Ember Report is a commercial information service that compiles, analyzes, and delivers wildfire incident intelligence — including a daily briefing, personalized alerts, notifications, and a searchable archive — to businesses operating in or around the wildland fire industry. The Service is provided for commercial and informational purposes only.
2. Not an emergency or life-safety service
The Service is not an emergency, evacuation, public-safety, or life-safety service and must never be relied on as one. We are not affiliated with, endorsed by, or an official source for any federal, state, tribal, or local agency. Wildfire conditions change rapidly, and the underlying data is largely human-entered by third parties we do not control. For any decision affecting personal safety, property, or life, rely on official authorities and emergency services (e.g., 911, InciWeb, your local emergency management agency) — not on the Service. See also Sections 8–9.
3. Timeliness
We aim to deliver information promptly after our sources update. Any timing claim we make refers to pipeline latency — how quickly we process and relay information once our sources publish it — and never to the timing of real-world events themselves. We do not guarantee that any event, order, or status change will be reported within a particular time, or at all.
4. Accounts and eligibility
You must be at least 18 and able to form a binding contract. You are responsible for the accuracy of your account information, for keeping your access credentials secure, and for all activity under your account. We use passwordless (magic-link) sign-in; keep access to your email account secure.
5. Subscriptions, billing, and cancellation
Some features are offered as a paid subscription ("Pro"). Pricing, billing frequency (monthly or annual), and any free-trial terms are shown at the point of sale. Paid subscriptions renew automatically at the then-current price until cancelled. Payments are processed by our payment provider, Stripe. Billing, renewal, trial, cancellation, and refund terms are governed by our Refund & Cancellation Policy, which is incorporated into these Terms by reference.
6. Acceptable use
You agree not to: resell, redistribute, republish, or commercially exploit the Service or its content except as expressly permitted; scrape, harvest, or bulk-download content or data; share your account or credentials; use the Service to build or train a competing product or dataset; circumvent access controls, rate limits, or paywalls; or use the Service unlawfully or to infringe others' rights. We may suspend or terminate accounts that violate these Terms.
7. Intellectual property; license
The Service — including its compilations, analysis, text, templates, and design — is owned by the Company and protected by law. Underlying factual data may originate from public and third-party sources; our rights attach to our selection, arrangement, analysis, and presentation. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your own internal business use while your subscription is active. All rights not expressly granted are reserved.
8. Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, completeness, timeliness, and non-infringement. We do not warrant that the Service will be uninterrupted or error-free, or that any information is accurate, complete, or current. You use the Service and rely on its information at your own risk.
9. Limitation of liability
To the maximum extent permitted by law, the Company and its officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, business, data, or goodwill, arising out of or relating to the Service, even if advised of the possibility. Our total aggregate liability for any claim relating to the Service will not exceed the greater of (a) the amount you paid us for the Service in the three (3) months before the event giving rise to the claim, or (b) US $100.
10. Indemnification
You will indemnify and hold the Company harmless from claims, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your content, or your violation of these Terms or applicable law.
11. Changes to the Service and Terms
We may modify or discontinue features at any time. We may update these Terms; material changes will be posted here with an updated date and, where appropriate, notified by email. Continued use after changes take effect constitutes acceptance.
12. Termination
You may stop using the Service and cancel at any time (see our Refund & Cancellation Policy). We may suspend or terminate access for violation of these Terms or as needed to protect the Service or comply with law. Provisions that by their nature should survive (e.g., Sections 7–10) survive termination.
13. Governing law; disputes
These Terms are governed by the laws of the State of California, without regard to conflict-of-laws rules. The state and federal courts located in the State of California have exclusive jurisdiction, and you consent to that venue, except that either party may seek injunctive relief in any court of competent jurisdiction.
